House’s condition angers neighbors

JOHNSTOWN - The owner of a blighted home at 27 S. Chase St. has until Tuesday to clean up the residence or face legal action, city Fire Chief Bruce Heberer said Thursday.

Heberer, the city's code enforcement officer, said the city has been working since August to clean up the situation. Neighbors have been complaining about the house.

"There's code violations," he stated. "Most of it is garbage and debris outside. The house is a total disaster inside."

Heberer said the house has been posted and is uninhabitable. He said he's received several complaints since the summer, and at least one dog was removed from the home.

The building's owner, Gloversville resident James Kennedy, said he's working with the city.

"I'm trying to get it cleaned up," he said.

Kennedy said he moved out of the home in April to live with his daughter, Kelly, because he is disabled. Now on a fixed income and living on Social Security, he said it has been tough to clean up the Johnstown home for several reasons. He said he let another daughter live there for awhile with dogs, and the residence subsequently became blighted.

Kennedy said he doesn't understand why the neighbors are ganging up and giving the home such attention.

"I feel there's a conspiracy," Kennedy said, alleging there are other residences in the Glove Cities with as many problems.

The fire chief said he's been in contact with the owner, who has until Tuesday to clean up the residence or be issued an appearance ticket for City Court.

Heberer said problems occurred after Kennedy moved out.

Neighbors of the two-story house said they've been complaining about the smell and garbage from the residence for years. They say there are rats in the home and the condition raises health concerns.

"They're [the city] never going to do anything," said Thomas Hill of Virginia, who owns a home at 113 E. State St. "This house is never, never going to be cleaned up."

He and other neighbors say the house is full of garbage, including bottles filled with urine, dog feces and hypodermic needles. Hill said the roof and windows have holes.

Hill has gone into the residence to document the situation by taking pictures.

Hill said squatters have used the home as their own, coming and going and never cleaning it up. He said the city Water Department shut off the water, but people still kept using it as a "flophouse."

"I think there should be some kind of cleanup," said another neighbor, Brenda Billa, of 25 S. Chase St.

She said she and other neighbors are considering getting a petition together.

Billa said the Fire Department and Animal Control Officer William Wock are "all familiar with the disgusting condition" of the house.

"As of now, there are large rats running around the house, inside and out," Billa said. "Windows are broken out and the glass is lying on the grass outside. There are large holes straight through the roof in many different areas, and many different animals are going through those holes and living in the attic."

Heberer said the main issue is to clean the garbage. The chief said talking about demolishing the house is premature. He said the building is "not falling down" and the city hasn't had a chance to address the house from a structural standpoint.

The city should exercise eminent domain and seize the property, then auction it off the same day. The proceeds could be put to good use for the elderly, recreation, schools, etc.

What a beautiful home! Yea it might need a little work, but seriously who hasn't done that to a toilet after eating Taco Bell??

See once again we allow people to let their homes look like this!! The people around this home pay taxes as well, why should they be "forced" to look at this?? Instead of getting this guy to court, you should arrest him and lock him (and the other parties up). I bet jail time would be a lot more effective than that of a fine that will never be paid.

Jail might be a wake up call he will answer too. A fine would just be more money not collected, that sits on the books!!

No, the dog that they got back was finally taken away a couple of weeks ago by the Animal Control Officer and the Police Dept. That's when I hear they found the drugs and needles etc. The two that were living there have warrents out for their arrests. Not sure for what, but there are a lot of different things it could be.

GoGreen-Let me rephrase what I said before. We didn't just watch the dogs starve. We called to the policed and the animal control numerous times and so did Mr Hill. The few times someone came and took the dogs, they were always returned after having a small fine paid.

Also, I was told that when the dogs were removed a couple of months ago, the owners (Mr Kennedy's daughter and her husband) were fined but we the tax payers are paying for the majority of this fine because they were low income. And, they were given their dog back to return to back to the same house.

All this is just so much ____. The place needs to be cleaned out,then maybe sanitized and saved or burned. The city apparently just *****foots around and does nothing? And I know from experence as a long-ago landlord that the Social Service Dept, if they're in on it, will do absolutely nothing but shirk total responsibility for anything. It's amazing how efficiently city and county 'authorities' melt into the woodwork when a pest house like this is 'suddenly' discovered. Kudos to the LH for reporting on it. Keep goading the authorities until something is done.

tinker - I agree with you. I have read a few times "I watched dogs starve to death". Yes it is the pet owner's responsibility to care for these animals, which obviously he was not. However, for someone to "watch" an animal suffer and starve is irresponsible as well. No matter where an animal is suffering, be it a clean or dirty environment, it needs to be reported - it is abuse and it is a crime. And that holds true for children. Don't "watch" them living in conditions like these, report it.

There are no excuses for such an unhealthy hazzardous house/property such as this. It just will not be tolerated in Johnstown. I cannot blame the immediate neighbors for being upset.

And Mr. Hill, this is not a conspiracy, this is just a community worried about safety and devalualization of their properties from an absolutely disgusting unsafe property.

I hate blight as much as the next guy, and feel there is no reason for it to be. After reading all these comments from concerned neighbors, I am appalled to think that you could stand by so long and watch these animals 'starve to death.' I question anyone's 'compassion' under those circumstances.

We are all aware that Mr Kennedy himself cannot do the cleaning of this house. We are sorry that he is disabled and we mean him no disrespect. However, even he claims that the blight is mostly from his daughter and her husband. He has family. If he can't do it, then he must find someone else to take on the task.

I know the daughter that he lives with.She took in her disabled father and cares for her 2 nephews. I agree with the neighbors I would not want to live near this. And this needs to be cleaned up. In this article it states the problems didnt occur until after Mr Kennedy left the home. His disabilities are a factor here, the man requires assistance to walk. No excuse but it is a factor.

I'm almost done... For those of you who still think that we are bad neighbors and terrible to complain when Mr Kennedy is disabled, please know that he has only been disabled for a year or so but this house has been in disgusting condition for over 20 years. You are all entitled to your opinion but as a neighborhood, we needed to finally take a stand.

Thank you to all who support us. Let's hope that the Code Enforcement and the other powers that be, follow through and make this clean-up happen.

Continuing with MY comment... Since we moved into this neighborhood, we have watched 3 or more dogs starve to death, outside attached to a 3 foot chain. Mr Hill would throw them food once in a while to try and keep them alive. Mr Kennedy has been gone only since April but this house has been a problem for years. The neighbors started stepping up only after we watched those dogs, living in a posted as uninhabitable dwelling, get thinner and thinner and howl and bark all night long. All of us as neighbors, do take care of each each other. It's obvious that we have to. How sad that all of us find it neccessary to dead bolt our doors and lock everything up tight even when we are home. We did not request for this house to be torn down. We just want it to be cleaned out because of unsanitary and unhealthy conditions. Frankly, we are afraid of taking it down before it is tented because of all that is most likely living there. (bugs, cockroaches, ants, RATS)

I would like to clarify some comments made about this house. First, we have lived near this house for 13 years and the whole time, it has been a filthy mess. We have witnessed drug deals happen at all hours of the day. We have reported the dogs living in their own feces in this house with no food or water for weeks. two dogs were removed and one had to be put down because it was in such bad condition. The other dog was given back to them and was brought back to the same house to live the same way as before. We neighbors, who some of you think are so terrible to pick on someone who's disabled, know that the holes in the roof, the animals (pigeons, squirrels, other birds etc) have lived in those eves for years. A few years ago, the ambulance was called to the house for a ****** overdose. Elementary children, (Mr Kennedy's grandchildren) were living there then. Also, we neighbors have been responsible for snowblowing their walkway, mowing their lawn, and loaning them our phones

no excuse for a place in this condition. slums in 3rd world countries are more respectable. shame on the owner. the place hes living now is probably headed for the same fate because it seems the family doesnt care either. tear it down at owners expense. maybe this should get wider exposure.

Well look on the bright side,if the economy goes bust there are enough rats in the neighborhood to eat. JUST KIDDING! I know some folks struggle to keep up on home repairs do to economy and high taxation.This is not one of those houses!This house is just plain nasty! It is probably so urine soaked a poop caked that it should be carefully demolished.Maybe even tented so they don't stir up all that bacteria and Rats carry hantavirus!
