Lawsuit filed over Johnstown car crash

JOHNSTOWN - A city official is suing a Fort Plain motorist over a summer accident that he says left him with severe injuries.

Johnstown Water Board President Nicholas A. Cannizzo Sr. and his wife, Geraldine M. Cannizzo, both of 3 O'Neil Ave., filed a civil lawsuit on Monday in state Supreme Court in Johnstown against Lydia A. Ponte of 4570 Route 10, Fort Plain.

The Cannizzos, represented by attorney Gerard McAuliffe of Johnstown, seek unspecified damages in the lawsuit.

The lawsuit claims negligence on the part of Ponte when on June 26 she allegedly failed to stop and yield on Grand Street before her vehicle struck Canizzo's eastbound vehicle on Briggs Street.

McAuliffe's court filing says Mr. Cannizzo suffered "serious bodily injury" requiring removal of a subdural hematoma, "significant" scarring, severe neck injury, cervical strain, elbow injury, bursitis, spine sprain and nervous system shock.
