Trial to look at absentee ballots

FONDA-The trial that will help decide the result of the 46th State Senate District election will begin reviewing absentee ballots today.

Acting Montgomery County Supreme Court Judge Guy Tomlinson heard legal arguments from both sides Monday in the continued race for the 46th district between Republican George Amedore and Democrat Cecilia Tkaczyk.

Kris Thompson, spokesman for Amedore's campaign, said Tomlinson reserved ruling on the motions until the legal debate over absentee and affidavit challenges would be completed.

Montgomery and Schenectady County ballots will be ruled on today, with Greene, Albany and Ulster to be ruled on Wednesday or later.

According to election commissioners from the counties, Albany County has 34 challenged ballots, Greene County has 117, Montgomery County has 31, Schenectady County has 74 and Ulster County has 521.
