Judge upholds ban on some ballots

FONDA- Acting Supreme Court Judge Guy Tomlinson upheld the bans on about half of the 73 Schenectady County ballots disputed by lawyers in the 46th State Senate District election trial, according to representatives of the Cecelia Tkaczyk campaign.

During proceedings Tuesday, Tomlinson ruled that 37 ballots would be cast aside, upholding the objections made on the ballots.

The results of this trial will help determine who wins the race between Republican George Amedore and Democrat Cecilia Tkaczyk. Amedore currently has a 111 vote lead. The final tally will be determined after the trial is over and the votes counted.

Gary Ginsburg, Tkaczyk's campaign spokesman, said he expects the trial will be finished today.

More than 800 ballots, coming from Montgomery, Albany, Greene and Ulster counties, still remain to be ruled on.
