Appeal in Senate case eyed

FONDA - An acting state Supreme Court Justice for Montgomery County has finalized the results of the 46th State Senate race, with Republican George Amedore declared the winner with a 37-vote lead over Democrat Cecilia Tkaczyk.

However, a spokesman for Tkaczyk's campaign said they will appeal the ruling.

According to Kris Thompson, Amedore's spokesman, Montgomery County Supreme Court Judge Guy Tomlinson on Wednesday certified the results in the 46th Senate District race, leaving George Amedore the winner by 37 votes.

The 46th Senate District includes includes all of Greene and Montgomery counties, and parts of Schenectady, Albany and Ulster counties.

Upon verification from the five county board of elections final numbers, Judge Tomlinson certified the final tally of 63,141 to 63,104 in favor of Amedore.

Gary Ginsburg, Tkaczyk's spokesman, said the race is not over.

"There are still hundreds of outstanding objections that have to be ruled on by the Appellate Court. Every voter has a right to have their voice heard in the electoral process, despite efforts to silence them due to minor errors and incorrect instructions," Ginsburg said.

Ginsburg was confident that once these ballots were heard, the decision would be final.

"When all the votes are counted, Cecilia Tkaczyk will be certified the winner of this election," Ginsburg said.

Ginsburg said lawyers will file the appeal as soon as possible.
