Lawsuit: Man fell due to ice on path

JOHNSTOWN - A Gloversville-Johnstown Wastewater Treatment Facility employee filed a lawsuit March 25 in state Supreme Court against a Johnstown paint company for falling on ice at its property.

Sewage treatment plant worker Steven Burns - represented by Latham attorney Peter J. Moschetti Jr. - filed a civil suit against Benjamin Moore & Co. of 161 Union Ave.

Court papers say Burns was at Benjamin Moore at 9 a.m. Feb. 1 - working for the sewer plant - when he slipped and fell on ice that accumulated on a path and walkway.

The lawsuit said the company had a duty to keep its grounds "reasonably safe" and the walkways Burns encountered represented an "extremely dangerous and defective condition." The lawsuit said the plaintiff "suffered serious personal injury, conscious pain and suffering, medical expense and financial loss."

No specific damages are sought, but the lawsuit demands judgment in a "substantial monetary amount."
