State upholds drug dealer’s sentence

ALBANY – State Supreme Court’s Appellate Division Thursday upheld the 2014 conviction of a town of Johnstown drug dealer.

The state’s highest court ruled on the conviction of Craig Rhodes, 45, of Johnson Avenue Extension. He pleaded guilty May 21, 2013 in Fulton County Court to third-degree criminal sale of a controlled substance. On Sept. 8, 2013, he received four years in state prison.

Appellate judges said that “contrary to defendant’s contention,” his waivers of the right to appeal were valid.

He was later sentenced as a second felony offender. Rhodes received four concurrent prison terms, followed by three years of post release supervision, together with an order directing his enrollment in a shock incarceration program.
