JOHNSTOWN?- The felony hearing originally scheduled for Friday has been rescheduled in the case against the Ephratah man accused of killing his mother, Fulton County District Attorney Louise K. Sira said in a news release Wednesday.
The hearing in the case against James F. Dibble has been set to take place Thursday in Ephratah Town Court, Sira said.
Attorney Gerard McAuliffe no longer represents the defendant, according to Sira. He was assigned new counsel – attorney Robert Abdella of Gloversville.
“The matter remains under active investigation, and we await laboratory testing of evidence seized,” Sira said in the release. “The Sheriff [Thomas Lorey] and I met with immediate family members and close friends for an hour on July 3, 2013. They are obviously distraught by their loss.”
Dibble, 29, is accused of fatally shooting his mother, Gwenda L. Lisman, 57, with a .22-caliber rifle at her home on Mud Road.
He was charged Monday with second-degree murder.
