Court upholds workman’s compensation challenge

ALBANY — The state Appellate Division on Thursday upheld a 2015 Worker’s Compensation Board decision involving a Montgomery County sheriff’s deputy who legally challenged the department and the board over money he was instructed to reimburse the county.

The ruling this week involved the matter of Kevin P. Collins, who in November 2011 sustained a work-related injury to his right knee. The deputy was awarded disability benefits, but the Worker’s Compensation Board four years later ruled the sheriff’s office was entitled to reimbursement for certain wages paid to the claimant during his period of disability.

Appellate judges also affirmed there was no underpayment by the county to Collins.
