Driving unlicensed sends two to prison

JOHNSTOWN — Two defendants who recently pleaded guilty in Fulton County Court to aggravated unlicensed operation counts in separate cases and are headed to County Jail and state prison.

James Davis, 58, of Avery Road, Stratford, on April 15 pleaded guilty before County Court Judge Michael W. Smrtic to first-degree AUO, as part of a plea arrangement.

Sentencing was adjourned until a later date, but he is expected to receive one to three years in state prison.

Davis was arrested Dec. 15, 2019.

In another case, Roger A. Hayden, 52, of Route 29, Broadalbin, pleaded guilty April 20 before Smrtic to first-degree AUO, as well as driving while ability impaired, as part of a plea arrangement.

He is due to be sentenced later to six months in the Fulton County Jail.

Hayden was arrested Oct. 23, 2019 by state police in Broadalbin.
