Man gets 5 years for drug conviction
ALBANY — A Johnstown man will serve the next five years in federal prison for possession with intent to deliver more than 100 grams of heroin mixed with fentanyl.
Victor M. Diaz, 30, was sentenced Friday to five years in prison, to be followed by four years of supervised release, for possessing and intending to distribute heroin mixed with fentanyl.
Diaz was arrested on March 7 when DEA agents and other law enforcement officers executed a federal warrant at Diaz’s Johnstown residence. They found him home, alone, and sitting near a suitcase containing 1,740 small glassine bags. The bags contained a total of approximately 89 grams of heroin mixed with fentanyl.
Officials also found, in a plastic container, an additional 53.5 grams of heroin mixed with fentanyl.
This case was investigated by the DEA and the Amsterdam Police Department, with assistance from the state police and the Gloversville Police Department, and was prosecuted by Assistant U.S. Attorney Michael Barnett.
Troopers: Man drove with .25 percent BAC
DAY — Nicholas S. Bourdeau, 38, of Hadley was charged by state police on Sunday with felony driving while intoxicated for being more than three times the legal limit.
At approximately 7:43 p.m., troopers were called to a residence in the town for a domestic dispute.
The victim explained that Bourdeau allegedly had returned from work intoxicated and when the victim took his keys away, he struck the person.
Bourdeau provided a breath sample which tallied his blood-alcohol content at 0.25 percent.
He was charged with aggravated driving while intoxicated.
Bourdeau was issued an appearance ticket. He is due in Town Court on October 19, at 5 p.m.
Troopers: Man had child pornography
AMSTERDAM — Edward Hurst, 21, of Amsterdam was charged by state police on Sept. 27 with promoting a sexual performance by a child younger than 17, a class D felony, and possessing sexual performance by a child, a class E felony.
Man charged with stealing a firearm
MAYFIELD — Matthew E. Waldvogel, 38, of Mayfield was charged by state police with fourth-degree grand larceny of a firearm on Sept. 26 for an incident which occurred in the town of Perth on Dec. 5.
Man charged with petit larceny
AMSTERDAM — Paulo A. Nunez Nieto, 40, of Amsterdam was charged by state police on Wednesday with petit larceny.
Man charged with trespassing
GLOVERSVILLE — State police charged John D. Beddow, 49, of Gloversville on Wednesday with tresspass for an incident which occurred on Aug. 4 in the town of Mayfield.
